Abstract

The article analyzes the functional continuities between institutions of Roman public law and equivalent structures of contemporary Ecuadorian constitutionalism, showing that certain legal architectures persist under new forms and normative foundations. Through a historical-comparative approach, three institutional pairs are examined: the auctoritas patrum and the prior constitutional control; the constitutiones principum and the binding opinions of the Attorney General's Office; and the senatus consulta and the decree-laws in states of emergency. The study articulates Romanist and constitutionalist contributions, together with Alan Watson's theory of legal transfer, to explain how legal systems adopt and resignify structures when they are functional. The results show that in both contexts there are mechanisms to filter, interpret and produce norms at decisive moments: validity filters, binding legal responses and extraordinary normative powers. Although the sources of legitimacy are transformed, from aristocratic prestige to constitutional supremacy, the structural functions are maintained. Thus, Rome operates as a conceptual matrix to understand elements of Ecuadorian public law. It is proposed to extend the comparison to other Andean countries to evaluate the regional validity of the Romanist legacy.
